Terms and Conditions

By entering the SeaLink Ferry for the Future Competition (the Competition), you agree to the  following terms and conditions:

1. Competition Organiser

The organiser of this Competition is Kangaroo Island SeaLink Pty Ltd (ABN 69 007 122 367) (including its group entities) of Level 3, 26 Flinders Street, Adelaide SA 5000 (SeaLink).

2. Who can enter

2.1 Entry is open to Reception to 12 (inclusive) primary and secondary school students who during the entirety of the period from 5 August 2021 to 15 October 2021 are either:

(a) enrolled in a South Australian primary, middle or secondary school; or
(b) registered or approved for home schooling by the relevant South Australian authority, (Participants).

2.2 Participants under the age of 18 years must have their parent or guardian’s approval and agreement to the terms and conditions of the Competition by completing the Parental Consent Form (which can be downloaded at www.sealink.com.au). The completed Parental Consent form must be uploaded to the online Competition entry form (which can be accessed at www.sealink.com.au) (Competition entry form), along with the entry.

2.3 Employees of SeaLink Travel Group Ltd and its subsidiary companies, and their immediate family members are ineligible to enter. ‘Employees’ refers to full-time and part-time employees, employed on either a permanent or casual basis. ‘Immediate family members’ refers to children or siblings of the employee.

SeaLink reserves the right at any time to make its own independent enquiries to verify the eligibility of Participant and to disqualify any Participant who does not meet the eligibility criteria of these Terms and Conditions. Each Participant authorises SeaLink to make enquiries of, and obtain information from, the relevant school at which the Participant is enrolled, their parent/guardian, any state or territory homeschooling authority or other entity, so that SeaLink may verify the information provided by Participants. All SeaLink’s decisions about the eligibility of Participants will be final and no correspondence will be entered into.

3. Competition Theme

3.1 The theme of the Competition is Design a Ferry of the Future.

4. How to Enter

4.1 The Competition commences at 9 a.m. ACST on Thursday 5 August 2021 and closes at 5:00pm ACST on Friday 15 October 2021 (Competition Period).

4.2 Entries in this Competition will be divided into individual and team entries in each of the following divisions (each a Division):

Primary Division (Reception to school year 6)

  • Individual entry (1 Participant); and
  • Team entry (maximum of  4 Participants in this Division);

Secondary Division (school years 7 – Year 12)

  • Individual entry (1 Participant); and
  • Team entry (maximum of 4 Participants in this Division);

(each referred to as an entry).

4.4 Participants must comply with these Terms and Conditions to be eligible to win a prize.

4.5 To enter the Competition, a Participant must be registered either as an Individual entry or as a member of a Team entry in a Division and must complete the following steps during the Competition Period to register:

(a) specify their full name, age, year of school, school (if they are enrolled at a school), if they are home-schooled, phone number, email address and mailing address on the Competition entry form;
(b) use the official SeaLink Design a Ferry for the Future template for their entry (available at www.sealink.com.au) (entry)
(c) provide a short description of up to 150 words on the relevant Competition entry form for their Division to explain the thinking behind the design for the judges (available at www.sealink.com.au)
(d) upload their entry in electronic format as a PDF or JPG file, to the relevant Competition entry form for their Division;
(e) for any individual or team member Participant under 18 years of age at the time they submit their entry, that Participant’s parent or guardian must authorise the Participant’s entry into the Competition, by completing and signing the Parental Consent Form which can be downloaded from the Competition webpage at www.sealink.com.au. The Participant must upload the completed and signed Parental Consent Form to their relevant Competition entry form along with their entry; and
(f) once they have specified the details set out at clause 4.3(a) and uploaded their entry and Parental Consent Form (as relevant) to the relevant Competition entry form, submit the completed Competition entry form online.

4.6 An entry must be received on the Competition entry form by 5pm ACST on Friday 15 October 2021.

4.7 A Participant may submit no more than one entry in each Division.

4.8 An entry may not be entered, or have been entered, in any other competition.

4.9 Entries which are considered by SeaLink to be offensive or otherwise inappropriate, defamatory, racist, or otherwise unlawful will be deemed invalid and will be excluded from the Competition.

4.10 Entries not submitted during the Competition Period or not completed in accordance with these Terms and Conditions will not be valid entries and will not be eligible to win.

5. Prize details

5.1 This is a competition based on skill and chance plays no part in determining the winner.

5.2 Prizes

There will be 1 prize winner in each Division as follows:

(a) Primary School Division (school Reception to Year 6)

  • Individual entry (1 Participant)
  • Team entry (maximum of 4 Participants)

(b) Secondary School (school years 7 to 12)

  • Individual entry (1 Participant)
  • Team entry (maximum of 4 Participants)

[Maximum of Ten (10) Prize winners in total]

The Individual prize winner from each Division will receive a SeaLink Kangaroo Island Travel Voucher valid for return SeaLink ferry travel for (4) passenger ferry fares and a vehicle (up to 5.0 metre standard vehicle length) and 2 nights' accommodation. Should the winner be Kangaroo Island-based, the accommodation in Adelaide will be based on Twin Superior Room for up to 4 people at the Crowne Plaza. Should the winner be mainland based, the accommodation on Kangaroo Island will be at the KI Seafront in Penneshaw based on a 2 Bedroom Villa for up to 4 people.

Group winners from each Division will each receive a SeaLink Kangaroo Island Travel Voucher valid for return SeaLink ferry travel for (4) passenger ferry fares and a vehicle (up to 5.0 metre standard vehicle length).

Any charges relating to the accommodation (including room service, meals, transfers, parking and other personal expenses and incidentals, outside of what has been included in this paragraph 5.2, are the responsibility of the winner and their family.

All winners will receive a specially numbered prize voucher with details of their prize and how to book. All ferry and accommodation bookings will need to be made through SeaLink by calling 13 13 01 or emailing [email protected] and detailing the prize voucher number, dates of travel requested, guest names, children’s ages and type of car. A booking confirmation will then be forwarded to the prize-winner. This booking confirmation should then be presented at ferry and accommodation check-in.

A credit card imprint or cash deposit may be required from the prize-winner and their family at the time of check-in at the hotel, for all incidental charges.

All prizes will be valid for travel to 31st March 2023. Any unused, or partially used prize vouchers will not be extended past this date.

5.3 Subject to this clause, the entry submitted by each winner (along with their name, age, school year and (if applicable) school) will be published on the SeaLink website at www.sealink.com.au. Each Participant consents and agrees, if they are a winner, to the publication of their entry (along with their name, age, school year and (if applicable) school) as described in this clause. SeaLink reserves the right to arrange publication of the winners and their entries in additional publications and websites, as necessary.

The judges and judging criteria

5.4 The entries will be evaluated through a two-step judging process:

(a) Firstly, representatives of SeaLink will review all entries and disqualify any entries which do not comply with these Terms and Conditions. The representatives will then list all valid Individual and Team entries in each Division for consideration by the Judging Panel.

(b) Secondly, a judging panel (Judging Panel) comprising SeaLink’s marine and vessel experts:

  • National Marine Fleet & Infrastructure Manager (or equivalent)
  • SeaLink Marine Operations Manager (or equivalent)
  • SeaLink Marine Engineer (or equivalent)
  • SeaLink Marketing Manager (or equivalent)

will evaluate all valid entries in each Division and select a winner from each category of each Division. SeaLink may substitute a person for one of the named panelists if necessary.

5.5 In selecting the winning entries, the Judging Panel will evaluate the entries in each category of each Division based on the following criteria:

(a) Primary School Division: Use of imagination, colour, fun, futuristic, and eco-friendly design features
(b) Secondary School Division: Use of Science, Technology, Engineering and Maths (STEM) based approaches to inject a more realistic interpretation and design, use of sustainable/eco-friendly design features, customer-centric design.

5.6 In addition to selecting a winning entry in each category from each Division, the Judging Panel reserves the right to select the next best entries in each category from each Division in order of merit, in the event that an original winning entry in a category is subsequently deemed ineligible or a winner is not able to claim their prize.

5.7 The Judging Panel’s decision on the winning entry in each category and next best entries, are final and no correspondence will be entered into.

Announcement and notification of winners

5.8 Winners will also be published in the Public Notices section of The Advertiser newspaper by 12 November 2021. By 3:00 pm ACST on Friday 29 October 2021 SeaLink will contact each winning Participant to inform them that their entry has been judged to be a winning entry. SeaLink will notify the winners via the contact details they specified on the Competition entry form.

5.9 Each Participant consents to SeaLink using the Participant’s entry in the event they are a winner (including a photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome).

5.10 The winner’s prize will be mailed to them at the Australian residential address which the winner specified on the Competition entry form, by 30 November 2021 or in person if agreed by SeaLink and the winner’s parent/guardian/school.

6. Prize Unavailability

In the event that a prize described above is unavailable, SeaLink reserves the right to substitute for the unavailable prize, a prize of equal or greater value. The prizes are non-transferable, cannot be exchanged or redeemed for cash. The two nights’ accommodation at either the Crowne Plaza in Adelaide, KI Seafront on Kangaroo Island, and SeaLink ferry travel are all subject to availability at the time of booking.

7. Intellectual Property

7.1 Each entry remains the property of the Participant who submits it.

7.2 Each entry must be the original work of the Participant submitting the entry and must not be copied from any other person’s work. By submitting an entry, each Participant warrants that their entry is their original work and they have not copied it from any other person’s work. If an entry uses text from someone else’s work, that use must be with the consent of the owner of the work and must attribute the author. By submitting an entry, each Participant warrants that s/he has complied with this requirement.

7.3 By entering the Competition, each Participant consents and grants a non-exclusive, royalty-free, perpetual licence to SeaLink using, reproducing, editing, communicating, publishing, and dealing with their entry (in whole, or in part) for an unlimited period without remuneration, in any media now known or hereafter devised, including within its ferries, for the purposes of promoting and administering the Competition, or promoting SeaLink. Without limiting the foregoing, Participants acknowledge and agree that their entry may be reproduced (in whole, or in part) online and in SeaLink promotional materials.

7.4 Each winner further grants a non-exclusive, perpetual, royalty-free licence to SeaLink to reproduce, edit and publish their entry on SeaLink’s website and digital marketing communications, along with a statement which includes an acknowledgement of each winner’s authorship of the entry, their age, school year and (if applicable) school.

7.5 Each Participant consents to any act or omission by SeaLink that would, in absence of such consent, infringe the Participant’s moral rights under the Copyright Act 1968 (Cth).

8. Privacy

8.1 By entering the Competition, each Participant is deemed to have expressly consented in accordance with the Privacy Act 1988 (Cth) and all other applicable privacy legislation to the collection, storage, disclosure and use of their personal information in the manner and for the purposes identified in these Terms and Conditions.

8.2 Each Participant acknowledges and agrees that SeaLink may, in order to conduct the Competition and for related purposes referred to in paragraph 8.3 below, collect, store and use personal information collected from or in relation to Participants by SeaLink or any of its group entities and disclose such information to third parties including any primary, middle or secondary school in South Australia, the South Australian Department of Education, employees of any of the foregoing, agents and contractors of SeaLink, suppliers of prizes for the Competition, and, if required, to Australian regulatory authorities.

8.3 By entering the Competition, each Participant acknowledges and agrees that SeaLink may, for an indefinite period, unless otherwise requested by the Participant in accordance with clause 8.4, collect, store, disclose and use all personal information collected by SeaLink from or in relation to the Participant in connection with this Competition, for promotional, marketing and publicity, research, and profiling purposes. All such personal information will only be used and disclosed in accordance with SeaLink’s privacy policy found here [https://www.sealinktravelgroup.com.au/privacy-policy/].  

8.4 Nothing in these Terms and Conditions affects a Participant’s right to access or correct their personal information under the Privacy Act 1988. Participants should direct any request to access, update, correct or withdraw consent to the use or disclosure of their personal information held by SeaLink to:

9. Limitation of Liability

9.1 To the maximum extent permitted by law and subject to applicable law, in the case of the intervention of any outside act or event which prevents or significantly hinders SeaLink’s ability to proceed with the Competition at all or on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, SeaLink may in its absolute discretion cancel, terminate or suspend the Competition at any time and SeaLink will have no liability to any Participant or any other person as a result of such cancellation, termination or suspension.

9.2 To the maximum extent permitted by law and subject to applicable law, SeaLink will not be liable for any misadventure, accident, injury, loss, cost, expense, or claim (including but not limited to a claim for infringement of any copyright, trademark or other intellectual property rights, or any claim of a similar nature) that may occur or be sustained in connection with, or as a result of, a Participant’s entry to the Competition.

9.3 SeaLink’s rights and obligations under these Terms and Conditions are subject to and limited by all applicable law and regulations.
